Key Elements of Practice in Family Proceedings - Draft Expectations Document consultation, MoJ (2013)
As part of the ongoing work to reform and strengthen practice across the family justice system, views are invited on a collection of 'expectation documents' developed by the Family Justice Board in collaboration with the judiciary. The documents set out the key contributions and good practice which the family courts can expect of Cafcass, local authorities, the Legal Aid Agency and HMCTS.
The documents do not introduce new requirements for agencies nor do they provide an exhaustive list of agencies' legal responsibilities. Rather, the aim is to provide a clear, concise and accessible summary of the main contributions and good practice which the courts can look to agencies to provide and which all agree are central to the just and efficient progression of cases and more timely decision-making for children.
The aim is to lend further support to the system, ensuring there is a greater consistency of view on what the essentials of good practice should comprise. In due course, the documents, along with similar good practice statements in relation to other agencies and professional groups within the system, are due to form part of the core content of the new Single Family Court Guide proposed by the judiciary.
