Draft legislation on Reform of provision for children and young people with Special Educational Needs

Children and young people who have a special educational need or disabilitydeserve the same life chances as every other child. But, too often, thesystems that should support them and their families fail them, puttingbureaucratic barriers in their way and failing to address their true needs.

In May 2012, we published Support and aspiration: A new approach to specialeducational needs and disability – Progress and next steps, to report onprogress following the 2011 Special Educational Needs and Disability (SEND)Green Paper.

That report provided proposals to reform provision for childrenand young people with special educational needs or with disabilities.This document now sets out the draft legislation to put those proposals intopractice, providing significant improvements to the support provided tochildren and young people, and to their parents. A single system wouldensure children and young people received the support they need regardlessof age or where they are taught, providing for them from birth until, whereappropriate, their 25th birthday, with comparable statutory rights andprotections throughout.

Local authorities in England would be required to work with local healthservices, to plan and commission support across education, health and socialcare. They would also be required to set out a local offer of the servicesavailable to children, young people and their families.
